Terms of Service

1. Parties and acceptance

These Terms govern use of Tempo Growth Tools (the Service), operated by GetRobo. Contact: contact@getrobo.xyz. By installing or using the Service, you accept these Terms on behalf of the business that owns or administers the BigCommerce store.

2. Eligibility

The Service is for business use. You must be at least 18, have authority to bind the business, and maintain an active BigCommerce store.

3. The Service

The Service lets merchants configure, preview, target and publish conversion, upsell, recovery, marketing, customer-experience and storefront-enhancement tools. It uses BigCommerce OAuth, catalog APIs, storefront APIs and Script Manager to provide these functions. Features may evolve while preserving the core purpose of the Service.

4. Access and security

You are responsible for authorized use of your BigCommerce account and for promptly reporting suspected misuse. We may store an encrypted BigCommerce access token to operate the Service.

5. Fees

Tempo may offer free and paid plans with storefront-interaction allowances. Current prices, limits, billing frequency, renewal and cancellation information are displayed in the BigCommerce Marketplace, the application or the purchase flow before an order is placed. When billing is completed through BigCommerce, BigCommerce's applicable billing terms also apply. At the storefront-interaction limit, eligible modules may enter a seven-day grace period and can then pause until the next period or a plan change. We do not directly process payment-card data.

6. Your content and responsibilities

You retain rights to campaign content, images, links, product selections and configuration that you provide. You grant us a limited license to process that content and shopper submissions solely to provide the Service. You are responsible for campaign claims, discount and coupon accuracy, shopper notices and consents, legal compliance, third-party rights and final storefront testing before publication.

7. Acceptable use

You must not interfere with the Service, probe it for vulnerabilities without authorization, evade limits, use it unlawfully, distribute malicious code, or attempt to access another merchant's data.

8. Intellectual property

We retain rights in the Service, software, interface, and Tempo branding. You retain rights in your store and submitted content. Feedback may be used to improve the Service without restriction or compensation.

9. Third-party services

The Service depends on BigCommerce, hosting and infrastructure providers, and optional country, font, exchange-rate and connected-workspace services described in the Privacy Policy. Their availability and your use of their services may be subject to their own terms. We are not responsible for third-party outages or platform changes beyond our reasonable control.

10. Privacy and data processing terms

Our Privacy Policy describes how information is processed and is incorporated into these Terms. To the extent Tempo processes personal data on behalf of a merchant, the merchant is the controller and GetRobo is the processor.

11. Connected workspaces

If a merchant enters Tempo through an authorized SpectoAI-connected workflow, the merchant authorizes the connected service to provide the BigCommerce credentials, scopes and entitlement information required to establish the Tempo workspace. SpectoAI features and credits are governed by the terms presented for that connected service and are not part of Tempo's storefront-interaction allowance.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or any specific sales or conversion result.

13. Limitation of liability

To the maximum extent permitted by law, GetRobo will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, data, or goodwill. Our total liability related to the Service will not exceed the amount paid for the Service during the three months before the event giving rise to the claim, or US$100 when no fee was paid.

14. Suspension and termination

We may suspend access for misuse, security risk, legal requirements, or BigCommerce requirements. You may terminate by uninstalling the app. A valid uninstall callback deletes the store record, tool configuration and stored shopper-submission events from the active database, subject to restricted backup retention and legal obligations.

15. Changes

We may update these Terms. Material changes will be communicated through the Service, email, or BigCommerce where appropriate. Continued use after the effective date means acceptance.

16. Governing law

These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. Disputes are subject to the competent courts in Poland, except where mandatory law provides otherwise.
